Proposed orders should conform to the court’s Guidelines Re: Proposed Orders and the court’s Local Bankruptcy Rules. You should also refer to the individual judge’s procedures on the court’s website to ensure you are preparing orders correctly for each judge and to see what other special procedures each judge has.

Top Ten Reasons Why Proposed Orders Are Returned For Resubmission

1. Incomplete Name
   If the debtor is a Sr., Jr., II, III, etc., the suffix should be included.
2. Submitted Prematurely
   Proposed orders related to matters served pursuant to LBR 9013 should be uploaded after the objection period has expired. 
3. Order Type
   Please select the appropriate order type. Proposed orders that the court directs a party to prepare after a hearing should be uploaded using Order Type “Hearing Held.” Matters that are of an urgent nature should be uploaded using Order Type “Expedited/Emergency” after chambers has been notified. 
4. Context of Order
   The context of proposed orders should match up with the docket. Proposed orders should refer to the motion, what happened, the reasons why the court is entering the order, and the relief granted or denied. Hearing dates and docket numbers should be accurate, and a legal description of property should be included, if applicable. 
5. Attachments
   Exhibits should be attached using the procedure outlined in the Guidelines Re: Proposed Orders. Simply uploading your exhibit with the proposed order will result in the judge’s electronic signature appearing on the exhibit, rather than the order where it belongs. 
6. Correction Orders
   A motion under Fed. R. Bankr. P. 9023 or 9024 (including the docket number and date of the original order) explaining the reason for the correction and the proposed order must be filed on the docket before uploading the proposed order into the eOrder program.
7. Blank Fields
   Proposed orders should not contain any blank fields. This includes a signature line for the judge. If you need a hearing date, please contact the judge’s calendar clerk before uploading the proposed order into the eOrder program. 
8. Last Page
   Proposed orders should have a minimum 2 inch blank margin to allow for the judge’s signature, and orders that run on a second page should contain at least two lines of the actual order language. A proposed order should not contain a blank signature page. 
9. Linkage
   Proposed orders must be linked to the motion/application which it relates to, not the certificate of no objection. 
10. Caption and Title
    Please refer to Local Bankruptcy Rule 9004, General Requirements of Form. “Proposed” should not be included in the title of the proposed order submitted for signature through the eOrder program.
